I'm considering Helen Doron over YBM ECC now, and the reviews are better. Let me know your thoughts.
I was offered a contract from a Helen Doron school recently. I watched some videos from that branch online and got super excited. The teachers seem really happy there. After reviewing this post from six months ago, I noticed a few differences to make me think that my contract is better, especially with the 30 teaching hours instead of 35. I'll be a first-time ESL teacher in Korea, so I want more experienced teachers to review this. I am also TESOL-certified. Can you please review and let me know if anything should be addressed before I sign?
Side Question about Article 17.2.I: Does being an affiliate for websites online like Amazon count as private and self-employment?

Contract
Article 1 (Duties)
Employee shall agree to perform the following duties at the institute designated by the Employer’s business policies during the term of this agreement:
  1. Teach students at the institute
  2. Develop and suggest educational programs for students and Employer
  3. Plan course schedule
  4. Prepare and make teaching materials and props
  5. Evaluate students
  6. Prepare a syllabus
  7. Fill out report cards
  8. Take field trips when necessary
  9. Meet with parents
  10. Supervise educational playtime
  11. Keep and arrange the teaching environment during rest time
  12. Prepare workshops and staff meetings
  13. Sharpen professional knowledge and techniques
  14. Perform other duties as designated by the Employer
  15. Substituting classes when needed
  16. The Employee is expected to be devoted to the institute for lesson preparations, student evaluations, reports, supervision of play, maintenance of the English environment, and upholding the Helen Doron methodology and goals.
  17. In addition to the above-mentioned duties, Employee will be required to participate in all events, teachers’ meetings, open classes, annual event workshops.
Article 2 (Place and Details of Work)
  1. Employee shall work at Helen Doron International in (omitted for safety).
  2. Employee shall perform the duties outlined in Article 1 under the Employer requests. However, Employer has a right to change the Employee's duties as necessary.
  3. Employee will be required to be physically active which may include sitting on the ground for long periods of time, standing up and sitting down, movements that go along with the curriculum, lifting of equipment and materials, etc. Employee should notify Employer of any prior health problems.
Article 3 (Term of Employment and Hours of Work)
  1. The term of employment shall begin on the (I asked the recruiter about this, because the dates were blank) unless separately agreed otherwise by the Employer and the Employee; this Contract shall automatically terminate at the end of the contract period set forth herein.
  2. If the Employee, for whatever reason, is unable to begin work on the date specified herein, the contract shall be re-written to indicate the new one-year Term of Employment. The contract will only take effect on the day the Employee actually begins work and the Term of Employment shall be a one-year period beginning from that day forth.
  3. The Employee shall work eight (8) hours per day for five (5) calendar days per week from Monday to Friday and shall not work on Saturdays and Sundays. Working hours are from 9am to 6pm, which include class hours, preparation time, and a lunch break of one (1) hour. Employee will be expected to also take the necessary time outside of working hours to thoroughly learn and prepare for their teaching if needed.
  4. Employee’s class instruction hours per week shall not exceed thirty (30) hours. Class instruction hours do not include class preparation, meals, staff meetings, or training seminars. If, however, the Employee’s actual weekly class instruction hours exceed thirty (30) hours due to supplementary class instruction, the Employee shall be entitled to additional pay calculated based upon ordinary wage.
  5. Employee will be required to participate in activities for the franchise or for improving teaching skills (for example, demo classes, open classes, or teacher trainings), which may fall on weekend days (no more than 5 weekend days a year). Employee will be paid a daily wage calculated based upon ordinary wage.
  6. Employee's hours of work, including training schedule, classes and teaching schedules may change, depending on the Employer's schedule. However, work hours will not exceed the eight (8) hours per day as stipulated in Article 3.4.
  7. Being late to work will result in having the Employee’s wages reduced accordingly. In the event the Employee is tardy for 10 or more minutes, employee’s wage shall be deducted and paid in proportion to actual working time. In the event the teacher is tardy 3 or more times, a written reprimand will be issued.
  8. If the Employee is absent for two or more consecutive work days without prior notification and approval from the Employer, he or she shall be deemed to have voluntarily resigned. When employee misses a class, the Employee’s wages will be reduced accordingly.
  9. If the school takes a break due to natural disasters (earthquakes, typhoon), the relevant day will either be substituted or be considered a non-paid holiday.
Article 4 (Orientation and Training)
  1. Employee is required to attend orientation and training provided by Employer before teaching students. Training will be held prior to the start of this agreement.
  2. Training may include demo classes for the institute.
  3. Orientation training dates and venues will be designated by the Employer.
  4. During orientation and training, Employer will provide accommodation for the Employee.
  5. For Pre-contract training days, Employee will be compensated minimum hourly wage stipulated in Korean law which training outlined in Article 4.1.
  6. Foreign employee should attend the Hagwon Association’s obligated annual Saturday training course, which is obligated by Korean law. The company will provide compensation for the day.
Article 5 (Wage)
  1. The Employee shall be paid a monthly wage of __ 2,200,000__ Korean Won. The monthly wage is based upon the duties outlined in Article 1. The Korean income tax, residence tax, medical insurance program, the national pension contribution, and any other tax or withholdings mandated by the various levels of government shall be withheld each month from the Employee’s salary.
  2. The Employee’s salary shall be paid on the 5th of the following month. If the 5th of the month falls on a Saturday, Sunday, or national holiday, the salary shall be paid on the proceeding business day.
  3. The Employee’s salary shall be deposited by the Employer to the Employee’s bank account.
  4. If the Employee has not worked all the normal working days in a month (excluding the allotted sick days or paid leave), for whatever reason, the Employee’s salary for that month shall be prorated for the corresponding number of days worked.
  5. If the Employee should be absent from work, for whatever reason, without having obtained prior approval from the Employer, the Employee’s salary for that month shall be prorated according to the corresponding number of unauthorized absent days.
  6. In the event the Employee is tardy for 10 or more minutes, the employee’s wage shall be deducted and paid in proportion to actual working time. In the event the teacher is tardy 3 or more times, a written reprimand will be issued.
  7. The Employee shall not claim against the Employer any compensation and/or payment other than those provided in this contract.
  8. Korean income tax, as outlined in Article 5.1, will be deducted from the employee’s salary according to the Korean income tax law. The Employee’s income is taxed according to the Korean Tax Law (including the Income Tax law). The tax liabilities of the Employee’s salary for the year are finalized through the year-end tax settlement. In the case where the Employee retires during the year, his/her income tax is finalized for the salary received until the moth of retirement.
  9. Employee shall pay 50% of the national pension, national health insurance and unemployment insurance, which will come out of the Employee’s monthly wage as outlined in Article 5.1.
Article 6 (Performance Evaluation and Bonus)
  1. The Employee will be evaluated by written or verbal comments by his/her supervisor. The Employer has the right to determine if a performance appraisal is needed on a monthly basis or more frequently. The evaluation will include a review of the Teacher’s job qualifications and performance; the quality of his/her work; knowledge of his/her job, job skills, and attitude toward job; working relations with co-workers, students and parents; initiative, attendance, punctuality, and/or disciplinary record. The review is designed to provide both the Teacher and his/her supervisors with time to discuss his/her strengths, weaknesses, career objectives and other concerns.
  2. Performance bonus may be paid, depending on business performance such as individual and group performance. Performance bonus is designed by the Employer and may not be requested by the Employee. Furthermore, a positive review of the Employee as mentioned in the section above, may not guarantee a bonus as outlined in this section.
Article 7 (Resignation)
  1. The Employee shall perform the duties set forth under Article 1 hereof during the Term of Employment set forth under Article 3 hereof.
  2. This contract is binding unless the Employee gives thirty (30) days written notice of termination (stating a planned date of resignation and reason(s) therefore) to the Employer.
  3. Failure of the Employee to give at least thirty (30) days written notice of termination to the Employer shall be reported to the Korean Immigration Service, resulting in the cancellation of the Employee’s work visa.
  4. A release letter will not be provided for a notice of less than sixty (60) days.
  5. In the case of resignation prior to the termination of this contract, the Employee shall reimburse the Employer for any visa costs, pre-contract training & accommodation costs and air fare, which will be deducted from the Employee’s monthly salary.
Article 8 (Renewal)
  1. The Term of Employment stated in Article 3 hereof may be renewed by the mutual written agreement of the Employer and the Employee.
  2. Employee shall give Employer a notice three months prior to the expiry of this contract to indicate their interest in renewing the contract. Both parties' agreement is necessary to renew this contract.
Article 9 (Airfare)
  1. Prior to the beginning of this contract, only in the case the Employee is coming from outside of the Republic of Korea, the Employer shall provide the Employee with a one-way ticket to the Republic of Korea from an international airport, which is mutually agreed upon by both the Employer and the Employee. Employer will book and purchase the most appropriate flight ticket according to the Employer’s needs.
  2. In the event the Employee fails to complete his/her contract, regardless of course or ground therefore (except in the event of the Employee’s decease), the Employee shall immediately pay back to the Employer the cost of the ticket outlined in Article 9.1. along with costs pertaining to visa paid by the Employer.
  3. If the Employee successfully completes his/her duties set forth in this contract for the full Term of at least one year of Employment specified herein, the Employer shall provide a one-way ticket back to the Employee’s country of residence. Departure date of the Employee will be a date agreed upon by both the Employee and the Employer. Air ticket provided cannot be exchanged for cash or transferred to another person. Employer does not agree to, and is not liable for, compensation to employee, whether in cash or otherwise, for air tickets which are not used by the employee.
  4. In the event that the Employee continues to stay in Korea, either for a non-employment purpose or employment purpose, neither air ticket nor equivalent value of currency will be offered.
Article 10 (Housing and Household Items to be provided)
  1. The Employer shall provide the Employee with a single housing chosen by the Employer. Housing selected by the Employer may be a leased house, a studio-type room, an apartment, or other form of lodging deemed sufficient by the Employer. The employer will be responsible for securing the housing and paying the deposit in full.
  2. Any and all fees, charges, costs, taxes, expenses, etc incurred in using the housing shall be borne by the Employee. Such fees may include but are not limited to electric, gas, and water utilities, internet, phone service, and maintenance fee from the landlord.
  3. The Employer may choose to provide temporary housing for the Employee until appropriate permanent housing can be obtained for the Employee.
  4. If the Employee wants housing allowance in lieu of the single housing, the Employee must notify the Employer prior to the start of the employment term. The employer shall provide the Employee with 400,000 Korean Won (KRW) per month as a rent subsidy upon the mutual agreement between the Employer and the Employee. If Employee chooses to receive the housing allowance, Employer will not be responsible for paying the housing deposit or securing housing.
  5. Once housing is decided, it shall not be subsequently changed during the Term of Employment. Any and all costs incurred by the Employee as a result of changing housing during the Term of Employment shall be borne by the Employee.
  6. Housing is provided for only the Employee. Employee may not have a roommate in any form during the Term of Employment without the prior consent of the employer.
  7. If the Employer provides housing for the Employee, the Employer shall provide the following appliances and furniture: a bed, table and chair, refrigerator, washing machine, gas or electric range, a closet or a clothing rack, and an air conditioner. The Employee shall not request or demand any other appliances or furniture than those stipulated herein. At the time of move in, Employee with Employer will check the condition of the appliances and furniture and will record the condition in the table below. Within 7 days of the Term of Employment being terminated and/or finished, the Employer will check the condition of the furniture and appliances. If the condition is damaged/broken or missing due to the Employee’s negligence, Employee will be responsible for fixing or replacing all damaged/broken/missing items.
  8. Inspection of the property can occur at any time, with 24 hours’ notice provided. During the inspection, the condition of the property will be assessed. In order to fix damages (e.g. mold) in a timely manner, fees for assessed damages due to the Employee’s negligence will be collected at the time of inspection and/or a time designated by the Employer, rather than at the end of the contract term.
  9. Smoking is not permitted on the premises. Any evidence of a violation of this policy will result in a fine determined by the landlord.
  10. Pets are not permitted on the premises. Any evidence of a violation of this policy will result in a fine determined by the landlord.
  11. Any utilities that are paid for by the Employer on behalf of the Employee will be deducted from the Employee’s salary upon mutual agreement between the Employer and Employee. If Employee does not agree to such deductions, Employee will be responsible for paying the Employer for the utilities.
  12. The Employer will withhold a safety deposit of 200,000 Korean Won from the Employee’s salary for the first three months of the EMPLOYMENT period for a total of 600,000 Korean Won. The safety deposit will be returned to the Employee when the term of employment is complete and inspection of housing and confirmation of all utilities being paid is complete. If employee fails to pay for any damages to the housing or the provided appliances and furniture, or if the employee fails to pay utilities, the payments will be deducted from the safety deposit. Any amount left in the safety deposit will be returned in full to the Employee.
  13. If the Employee uses the housing provided by the Employer, the Employee shall leave the housing in the same condition as when it was first occupied and the Employee shall be liable for any damage they cause to the building, appliances, and furniture incurred during the term of this agreement.
  14. At the end of the contract employee will be pay 60,000 won for the flat cleaning fee.
Article 11 (Annual Paid Leave and Sick Leave)
  1. Employee shall be entitled to annual paid leave in accordance with the Korean Labor Standards Act as below and public holidays during the Term of the Employment set forth under Article 3 hereof.
A. The Company shall grant one (1) annual paid leave for every one month of perfect attendance when an employee whose consecutive service year is less than one (1) year.
B. After the first year of service, an employee whose attendance rate is 80% or more shall receive (15) days of annual paid leave.
C. One day extra paid leave for each two years of consecutive service in addition to the leave prescribed in paragraph (b). In this case, the total number of annual paid leaves and the extra leaves shall not exceed 25.
  1. The Employee entirely agrees on a voluntary basis to take the said annual paid leaves for five (5) days in the summer and five (5~8) days in the winter, where the annual paid leaves are allowed only during the days allotted on the Helen Doron Korea calendar. The remaining annual paid leaves will be taken according to the annual school calendar unless otherwise agreed with the employer.
  2. In the case of contract termination, paid leave shall be pro-rated based on the actual number of days of Employment. If the Employee used more than the allowed annual paid leaves that he or she is entitled to, the remaining days specified in the foregoing clause 1 shall be surrendered and unpaid.
  3. The Employee shall be entitled to a paid Sick Leave in the case of any illness or injury that prevents the Employee from performing the duties herein only with the express consent of the Employer. The Employee shall notify the Employer of any absence due to sickness within one (1) hour of the beginning of the Employee’s duties. The Employee’s paid Sick Leave during the term of employment shall not exceed three (3) working days. In the event that the total number of annual sick leaves exceeds 3 days, the days of absence shall be considered as unpaid vacation, and will therefore be deducted from the Employee’s monthly wage.
  4. If the Employee is found to be claiming a false sickness or submits false documentation, the Employer will be issued a 30 days’ notice in advance of termination.
Article 12 (Health Insurance, Accidental, National Pension, Taxes)
  1. The Employee will be covered by the Korean National Health Insurance and Pension. According to the government guideline for teachers, the monthly insurance and pension will be shared in half with the Employer. Therefore, Employer will cover 50% of the Employee’s health insurance and pension costs.
  2. Employee may be eligible for tax and/or pension refund; however, it is the Employee’s responsibility to contact the necessary parties to arrange this. Employer will not be responsible for making sure the Employee gets refunded and is not required to assist the Employee.
  3. In the event that the Employee sustains injuries from an accident or mishap outside of the work hours, the Employer will not be responsible or obligated to pay any medical or hospital costs which are in excess of those covered by the medical insurance provided in point 1 of this article.
  4. Taxes and deductions in compliance with Korean Law shall be withheld automatically from the Employee’s monthly salary. The deductions will be income tax, residence tax, medical insurance (50%) and National Pension scheme (50%) and so forth if any, from monthly and severance payment. The total amount of income tax deducted is 3.3% of the Employee’s monthly salary. Income tax includes all incomes paid by the employer.
Article 13 (Severance Pay)
  1. When Employee leaves the institute, Employer shall pay thirty (3) days average salary for each full year of Employee's service (by Korean Law).
  2. When there is ground prescribed by presidential decree, Employer may pay, upon the request of Employee who has been employed for more than one year, Employee an early withdrawal of severance pay. In such cases, the years of employment to calculate severance pay shall newly begin from the date on which early withdrawal is made out.
  3. Severance pay shall be made within 14 days after the date on which Employee left the institute. In the event of early withdrawal, severance pay shall be made out on the first payday after the date on which Employee made such request. In case that the employee is leaving the country, employee shall pay on employee's last working day.
Article 14 (Confidentiality)
  1. Definition of Confidential Information. For the purpose of this Article, "confidential information" means the following:
A. Trademarks developed or registered by Helen Doron, such as Helen Doron Early English, Didi the Dragon, Polly the Collie, Mathjogs, Mathriders, Multimusik, Ready Steady Move and Dada Vinci;
B. Unique and incidental methods distributed through the franchise system of the institute, and other products acquired or developed by the institute, even though they are not yet registered;
C. Entire or any part of information devised by developers or their staff, or any information derived, discovered or developed there from, including but not limited to a discovery, idea, concept, technology, design, customer information, such as customer names, and financial information.
  1. Entire or any part of confidential information shall not be communicated, reported, published, disclosed or passed on to other parties or companies in a direct or indirect manner for the purposes other than those agreed between Employee and developers.
  2. Employer shall pay Employee (all instructors are deemed to be handling confidential information) 50,000 Korean Won per month as a confidentiality allowance, which is included in the salary written in Article 3.1.
  3. At the time of the termination of employment contract, Employee shall immediately return Employer all confidential materials, such as annotations, data, references, maps, models, reports, manuals, documents, reports containing aforementioned contents and other similar items.
  4. Confidentiality obligation prescribed in this Article is in effect for the period of his/her employment and until one year after Employee leaves the institute.
  5. In order to enforce this clause, Employee is prohibited to work at other English institute which teaches kindergartners or elementary school students with the same or similar curriculum or text books for the period of his/her employment contract. Employee is also prohibited to work at or open up same kind of institutes in his/her or third party's name for six months after contract termination.
  6. Employee is prohibited to work in other English institutes within a 5 km radius of Helen Doron Institutes for 1 year after leaving this workplace.

A. All the text books developed by the HDEG, List of current courses: Baby’s Best Start, It’s a Baby Dragon, Fun with Flupe, More Fun with Flupe, Polly and Nat, Didi the Dragon, Polly the Collie, Jump with Joey, More Jump with Joey, Play On, Botty the Robot, English through Drama, Eureka Maths, Ready Steady Move, Multi-Musik and also including the text books developed by HD& HDK after March 2013.

Article 15 (Regulation)
  1. Employee shall conform to all rules set by Employer, and may not refuse to follow his/her supervisor's instructions without justifiable grounds.
  2. Employee shall not engage in another job or profit-making without attaining prior approval from Employer.
  3. Employee shall not leave work or be absent without Employer's permission. Absence without permission may result in prorated deduction from monthly wage, and two consecutive absences without permission may result in termination of employment.
  4. Employee is prohibited from receiving unreasonable money or entertainment related to his/her job from students and their parents.
  5. Employee shall follow rules and orders in the institute, and shall not drink in a manner which will affect his/her behavior in the institute, gamble, borrow or lend money for profit, sell goods, force donation or engage in any other similar activities that may affect their behavior in the institute.
  6. Employee shall put efforts to keep his/her performance and to develop his/her skills.
  7. Korean Immigration Law requires all foreigner English teachers to receive health checks (HIV, Drug test for heroin, meth, cocaine, and other transmitted diseases) upon their arrival. The health check will be arranged by the Employer; however, the cost of the health check will be borne by the Employee. The cost of the health check will be deducted from the Employee’s first pay in the case Employee is not available to pay for the health check on arrival. If the Teacher receives a positive HIV or drug results, the Employee’s E2 visa will be cancelled by the Korean Immigration Office. In this case, the Employee will be responsible for paying back employer the cost of the air ticket to Korea as well as purchasing their flight ticket to leave Korea.
Article 16 (Hygiene, Presentation, Communication)
  1. Employee shall be presentable at all times and will maintain a high level of hygiene and will be presentable during employment.
  2. Employee shall wear smart casual attire. Clothes with holes or wrinkles should be avoided. Sweatpants, shorts above the knees, mini-skirts, and tank tops are prohibited unless prior approval is given by the Employer. In addition, any kinds of body piercings and visual tattoos must be covered or removed during work hours.
  3. Employee shall communicate positively with co-workers, students and parents.
  4. Employee shall be a non-smoker during working hours and will not smoke on the premises or within 2km radius of the work place at any time during the term of this agreement.
  5. Any violation of the above clauses could result in disciplinary action.
Article 17 (Disciplinary Action and Aggravation)
  1. The Employer has the right to terminate the Employee for the reasons listed below. The Employer and the Employee may terminate the contract with a written notice given 30 days in advance. In addition, Employee shall reimburse Employer for any and all costs incurred due to the Employee’s actions. Any fees borne by the Employer for transportation and visa fees shall be deducted from the Employee’s monthly salary.
  2. The Employer may legally terminate or cancel this contact upon occurrence of any one or more of the following events:
D. The Employee violates Korean laws or has been sentenced to prison;
E. The Employee violates the duties in Article 1 of this contract.
F. The Employee violates the confidentiality agreement outlined in Article 14 of this contract
G. The Employee violates the regulations outlined in Article 15 of this contract
H. The Employee fails to perform or unsatisfactorily performs any of the duties stipulated in this contract. This may include neglecting his/her responsibilities as outlined in this contract; leaving work frequently; giving poor-quality or ineffective lessons, causing frequent complaints on the quality of instruction from students and parents; neglecting his/her duty to keep up with job-related reports without giving notice of justifiable grounds; when behavioaction damages the reputation of the Employer, and other details outlines in this contract. In this event, the Employer shall provide formal written notice of unsatisfactory performance to the Employee. Two or more written notices shall be considered sufficient grounds for termination of this contract.
I. The Employee engages in any other employment (including any part-time, private or selfemployment, or online instruction) during the Term of Employment.
J. The Employee fails to perform his/her duties for more than two working days without receiving prior consent from the Employer.
K. Any of the information provided in the Employee’s application is false or inaccurate.
L. The Employee fails the medical health check in Korea in accordance with the requirements of the Korean immigration office.
M. It is determined that the Employee is prevented from or incapable of performing the duties set forth under Article 1 hereof for any medical reason, whether it is physical or psychological in nature, including chronic ailments such as diabetes mellitus, high blood pressure, chronic liver diseases, tuberculosis, neurologic disorder, substance or alcohol addiction, etc. If requested to take a physical and/or psychological examination by the Employer, the Employee must make themselves available. The Employee must agree to take a health at the request of the Employer and submit the results. All related expenses shall be borne by the Employee.
N. The Employee comes to work under the influence of alcohol or illegal drugs; or
O. The Employee has approached a student with sexual intent, or has a sexual relationship with a student;
P. The Employee has committed other misconducts inappropriate as an instructor, damaging the academy's reputation;
Q. The Employee has received two warning letters from Employer for dereliction of duties or misconduct. Employer will review and evaluate the situation prior to issuing the warning letter;
R. The Employer has other reasons equivalent to subparagraphs A through N.
  1. If Employee concerned has committed gross negligence or has been subject to disciplinary action before, he/she may be subject to aggravated action, depending on the magnitude and time of disciplinary action taken before.
  2. Employer may take disciplinary actions (Reprimand/Reduction of pay/Temporary suspension/ Demoted/Termination of employment) when Employee:
A. leaves work frequently;
B. violates the duties in Article 1 of this contract
C. violates laws in a blunt manner, while performing his/her job or all other activities;
D. has violated Employer's rules on absence or code of conducts;
E. causes loss to Employer;
F. conducts in any behavior that violates the terms of this contract
G. The Employer has other reasons equivalent to subparagraphs A through F
Article 18 (Compensation for Damage)
In the event that Employee has caused loss to Employer as a result of breaching this contract or violating laws due to reasons attributable to Employee (e.g. leaving without enough notice, speaking badly of the institute, hurt other employees(verbally or physically) or any other intentional behavior that causes damage), Employer may put a claim against Employee for compensation.
Article 19 (Commercial Rights)
Employer reserves the right to use any and all materials produced by the teacher for commercial purposes. Materials shall include but not be limited to photos, videos, voice recordings, and teaching materials produced.
Article 20 (Termination of Employment or Leaving Work)
  1. This contract shall be terminated if Employee fails to pass all of Helen Doron's training programs.
Article 21 (Jurisdiction)
This contract will be interpreted according to the internal (domestic) laws of the Republic of Korea. A competent court in the Republic of Korea will have jurisdiction in regard to any dispute or claim arising out of, or in connection with, this contract.
Both parties have read, fully understood and agreed on the terms and conditions of the contract written in English and will attempt to resolve any possible dispute in a reasonable manner.
Article 22 (Special Agreement)
This agreement shall be the sole and entire agreement between the two parties named above. Both parties acknowledge all the terms set forth in said agreement. Agreement is binding between said parties. This agreement shall be in effect upon execution by both parties.

hi everyone! i was hoping i could get this contract reviewed, as i'm a first time teacher and am still getting used to understanding what are green/red flags in contracts. i had a skype interview with the director which i thought went fantastic; she seemed super nice at face value (which director isn't at first??). this helen doron is a new location opening september 1st in mokgam and myself (potentially) and one other foreign teacher will be 2 out of 5 staff members (2 other korean teachers + the director herself). most things here seemed in line with what she said, and i felt things felt pretty legitimate when i was talking with her. i've bolded + italicized a few things that i either am not familiar with or would like more opinions on. thanks in advance to whoever takes the time to look this over!! :)
Employment Contract
This contract of employment is made on the 10th of July 2019 between Helen Doron Korea (hereinafter "Employer") and _________________(hereinafter "Employee" or "teacher") as follows:
Date of Employment Position: Full Time Teacher
Article 1 (Duties) Employee shall agree to perform the following duties at the institute designated by the Employer’s business policies during the term of this agreement:

  2. Develop and suggest educational programs for students and Employer
  3. Plan course schedule
  4. Prepare and make teaching materials and props
  5. Evaluate students
  6. Prepare a syllabus
  7. Fill out report cards

  13. Sharpen professional knowledge and techniques

  17. In addition to the above mentioned duties, Employee will be required to participate in all events, teachers’ meetings, open classes, annual event workshops.
  18. In addition, Employee is participated on the weekedns, when it is required.

Article 2 (Place and Details of Work)
  1. Employee shall work at Helen Doron English in Mokgam.
  2. Employee shall perform the duties outlined in Article 1 under the Employer requests.
However, Employer has a right to change the Employee's duties as necessary.
  1. Employee will be required to be physically active which may include sitting on the ground for long periods of time, standing up and sitting down, movements that go along with the curriculum, lifting of equipment and materials, etc. Employee should notify Employer of any prior health problems.
Article 3 (Term of Employment and Hours of Work)
  1. The term of employment shall begin on the 19th of Aug,2019 until 18thofAug2020
Unless separately agreed otherwise by the Employer and the Employee; this Contract shall automatically terminate at the end of the contract period set forth herein.
  1. If the Employee, for whatever reason, is unable to begin work on the date specified herein, the contract shall be rewritten to indicate the new one-year Term of Employment. The contract will only take effect on the day the Employee actually begins work and the Term of Employment shall be a one-year period beginning from that day forth.
  2. The Employee shall work eight (8) hours per day for five (5) calendar days per week from Monday to Friday. Working hours are from 9:30am to 6:30pm, which include class hours, preparation time, and a lunch break. Employee will be expected to also take the necessary time outside of working hours to thoroughly learn and prepare for their teaching if needed.
  3. Employee’s class instruction hours per week shall not exceed thirty (35) hours. Class instruction hours do not include class preparation, meals, staff meetings, or training seminars. If, however, the Employee’s actual weekly class instruction hours exceed thirty (35) hours due to supplementary class instruction, the Employee shall be entitled to additional pay calculated based upon ordinary wage.
  4. Employee will be required to participate in activities for the franchise or for improving teaching skills (for example, demo classes, open classes, or teacher trainings), which may fall on weekend days (no more than 5 weekend days a year). Employee will be paid a daily wage calculated based upon ordinary wage.
  5. Employee's hours of work, including training schedule, classes and teaching schedules may change, depending on the Employer's schedule. However, work hours will not exceed the eight (8) hours per day as stipulated in Article 3.4.
7. Being late to work will result in having the Employee’s wages reduced accordingly. In the event the Employee is tardy for 10 or more minutes, employee’s wage shall be deducted and paid in proportion to actual working time. In the event the teacher is tardy 3 or more times, a written reprimand will be issued.
8. If the Employee is absent for two or more consecutive work days without prior notification and approval from the Employer, he or she shall be deemed to have voluntarily resigned. When employee misses a class, the Employee’s wages will be reduced accordingly.
Article 4 (Orientation and Training)
  1. Employee is required to attend orientation and training provided by Employer before teaching students. Training will be held prior to the start of this agreement.
  2. Training may include demo classes for the institute.
  3. Orientation training dates and venues will be designated by the Employer.
  4. During orientation and training, Employer will provide accommodation for the Employee.
  5. Employee will be paid 30,000 Korean Won per day of orientation and training outlined in Article 4.1 if he/she passes the training program.
Article 5 (Wage)
  1. The Employee shall be paid a monthly wage of 2,400,000 Korean Won. The monthly wage is based upon the duties outlined in Article 1. The Korean income tax, residence tax, medical insurance program, the national pension contribution, and any other tax or withholdings mandated by the various levels of government shall be withheld each month from the Employee’s salary.
  2. The Employee’s salary shall be paid on the 10th of the following month. If the 10th of the month falls on a Saturday, Sunday, or national holiday, the salary shall be paid on the proceeding business day.
  3. The Employee’s salary shall be deposited by the Employer to the Employee’s bank account.
  4. If the Employee has not worked all the normal working days in a month (excluding the allotted sick days or paid leave), for whatever reason, the Employee’s salary for that month shall be prorated for the corresponding number of days worked.
  5. If the Employee should be absent from work, for whatever reason, without having obtained prior approval from the Employer, the Employee’s salary for that month shall be prorated according to the corresponding number of unauthorized absent days.
6. In the event the Employee is tardy for 10 or more minutes, the employee’s wage shall be deducted and paid in proportion to actual working time. In the event the teacher is tardy 3 or more times, a written reprimand will be issued.
  1. The Employee shall not claim against the Employer any compensation and/or payment other than those provided in this contract.
  2. Korean income tax, as outlined in Article 5.1, will be deducted from the employee’s salary according to the Korean income tax law. The Employee’s income is taxed according to the Korean Tax Law (including the Income Tax law). The tax liabilities of the Employee’s salary for the year are finalized through the year-end tax settlement. In the case where the Employee retires during the year, his/her income tax is finalized for the salary received until the moth of retirement.
  3. Employee shall pay 50% of the national pension, national health insurance and unemployment insurance, which will come out of the Employee’s monthly wage as outlined in Article 5.1.
Article 6 (Performance Evaluation and Bonus)
  1. The Employee will be evaluated by written or verbal comments by his/her supervisor. The Employer has the right to determine if a performance appraisal is needed on a monthly basis or more frequently. The evaluation will include a review of the Teacher’s job qualifications and performance; the quality of his/her work; knowledge of his/her job, job skills, and attitude toward job; working relations with co-workers, students and parents; initiative, attendance, punctuality, and/or disciplinary record. The review is designed to provide both the Teacher and his/her supervisors with time to discuss his/her strengths, weaknesses, career objectives and other concerns.
  2. Performance bonus may be paid, depending on business performance such as individual and group performance. Performance bonus is designed by the Employer and may not be requested by the Employee. Furthermore, a positive review of the Employee as mentioned in the section above, may not guarantee a bonus as outlined in this section.
Article 7 (Resignation)
  1. The Employee shall perform the duties set forth under Article 1 hereof during the Term of
Employment set forth under Article 3 hereof.
  1. This contract is binding unless the Employee gives thirty (30) days written notice of termination (stating a planned date of resignation and reason(s) therefore) to the Employer.
3. Failure of the Employee to give at least thirty (30) days written notice of termination to the Employer shall be reported to the Korean Immigration Service, resulting in the cancellation of the Employee’s work visa.
  1. A release letter will not be provided for a notice of less than sixty (60) days.
5. In the case of resignation prior to the termination of this contract, the Employee shall reimburse the Employer for any visa costs, pre-contract training & accommodation costs and air fare, which will be deducted from the Employee’s monthly salary.
Article 8 (Renewal)
  1. The Term of Employment stated in Article 3 hereof may be renewed by the mutual written agreement of the Employer and the Employee.
  2. Employee shall give Employer a notice three months prior to the expiry of this contract to indicate their interest in renewing the contract. Both parties' agreement is necessary to renew this contract.
Article 9 (Airfare)
  1. Prior to the beginning of this contract, only in the case the Employee is coming from outside of the Republic of Korea, the Employer shall provide the Employee with a one- way ticket to the Republic of Korea from an international airport which is mutually agreed upon by both the Employer and the Employee. Employer will book and purchase the most appropriate flight ticket according to the Employer’s needs.
2. In the event the Employee fails to complete his/her contract, regardless of course or ground therefore (except in the event of the Employee’s decease), the Employee shall immediately pay back to the Employer the cost of the ticket outlined in Article 9.1. along with costs pertaining to visa paid by the Employer.
  1. If the Employee successfully completes his/her duties set forth in this contract for the full Term of at least one year of Employment specified herein, the Employer shall provide a one-way ticket back to the Employee’s country of residence. Departure date of the Employee will be a date agreed upon by both the Employee and the Employer. Air ticket provided cannot be exchanged for cash or transferred to another person. Employer does not agree to, and is not liable for, compensation to employee, whether in cash or otherwise, for air tickets which are not used by the employee.
  2. In the event that the Employee continues to stay in Korea, either for a non-employment purpose or employment purpose, neither air ticket nor equivalent value of currency will be offered.
Article 10 (Housing and Household Items to be provided)
  1. The Employer shall provide the Employee with a single housing chosen by the Employer. Housing selected by the Employer may be a leased house, a studio-type room, an apartment, or other form of lodging deemed sufficient by the Employer. The employer will be responsible for securing the housing and paying the deposit in full.
  2. Any and all fees, charges, costs, taxes, expenses, etc incurred in using the housing shall be borne by the Employee. Such fees may include but are not limited to electric, gas, and water utilities, internet, phone service, and maintenance fee from the landlord.
  3. The Employer may choose to provide temporary housing for the Employee until appropriate permanent housing can be obtained for the Employee.
  4. If the Employee wants housing allowance in lieu of the single housing, the Employee must notify the Employer prior to the start of the employment term. The employer shall provide the Employee with 400,000 Korean Won (KRW) per month as a rent subsidy upon the mutual agreement between the Employer and the Employee. If Employee chooses to receive the housing allowance, Employer will not be responsible for paying the housing deposit or securing housing.
  5. Once housing is decided, it shall not be subsequently changed during the Term of Employment. Any and all costs incurred by the Employee as a result of changing housing during the Term of Employment shall be borne by the Employee.
  6. Housing is provided for only the Employee. Employee may not have a roommate in any form during the Term of Employment without the prior consent of the employer.
  7. If the Employer provides housing for the Employee, the Employer shall provide the following appliances and furniture: a bed, table and chair, refrigerator, washing machine, gas or electric range, a closet or a clothing rack, and an air conditioner. The Employee shall not request or demand any other appliances or furniture than those stipulated herein. At the time of move in, Employee with Employer will check the condition of the appliances and furniture and will record the condition in the table below. Within 7 days of the Term of Employment being terminated and/or finished, the Employer will check the condition of the furniture and appliances. If the condition is damaged/broken or missing due to the Employee’s negligence, Employee will be responsible for fixing or replacing all damaged/broken/missing items.

8. Inspection of the property can occur at any time, with 24 hours’ notice provided. During the inspection, the condition of the property will be assessed. In order to fix damages (e.g. mold) in a timely manner, fees for assessed damages due to the Employee’s negligence will be collected at the time of inspection and/or a time designated by the Employer, rather than at the end of the contract term.
  1. Smoking is not permitted on the premises. Any evidence of a violation of this policy will result in a fine determined by the landlord.
  2. Pets are not permitted on the premises. Any evidence of a violation of this policy will result in a fine determined by the landlord.
  3. Any utilities that are paid for by the Employer on behalf of the Employee will be deducted from the Employee’s salary upon mutual agreement between the Employer and Employee. If Employee does not agree to such deductions, Employee will be responsible for paying the Employer for the utilities.
12. The Employer will withhold a safety deposit of 200,000 Korean Won from the Employee’s salary for the first three months of the EMPLOYMENT period for a total of 600,000 Korean Won. The safety deposit will be returned to the Employee when the term of employment is complete and inspection of housing and confirmation of all utilities being paid is complete. If employee fails to pay for any damages to the housing or the provided appliances and furniture, or if the employee fails to pay utilities, the payments will be deducted from the safety deposit. Any amount left in the safety deposit will be returned in full to the Employee.
  1. If the Employee uses the housing provided by the Employer, the Employee shall leave the housing in the same condition as when it was first occupied and the Employee shall be liable for any damage they cause to the building, appliances, and furniture incurred during the term of this agreement.
Article 11 (Annual Paid Leave and Sick Leave)
  1. Employee shall be entitled to annual paid leave in accordance with the Korean Labor Standards Act of a total of twelve (12) working days and public holidays during the Term of the Employment set forth under Article 3 hereof. The Employee entirely agrees on a voluntary basis to take the said annual paid leaves for five (5) days in the summer and five (5) days in the winter, where the annual paid leaves are allowed only during the days allotted on the Helen Doron Korea calendar. The remaining two (2) annual paid leaves will be taken according to the annual school calendar unless otherwise agreed with the employer.
  2. In the case of contract termination, paid leave shall be pro-rated based on the actual number of days of Employment. If the Employee used more than the allowed annual paid leaves that he or she is entitled to, the remaining days specified in the foregoing clause 1 shall be surrendered and unpaid.
  3. The Employee shall be entitled to a paid Sick Leave in the case of any illness or injury which prevents the Employee from performing the duties herein only with the express consent of the Employer. The Employee shall notify the Employer of any absence due to sickness within one (1) hour of the beginning of the Employee’s duties. The Employee’s paid Sick Leave during the term of employment shall not exceed three (3) working days. In the event that the total number of annual sick leaves exceeds 3 days, the days of absence shall be considered as unpaid vacation, and will therefore be deducted from the Employee’s monthly wage.
  4. If the Employee is found to be claiming a false sickness or submits false documentation, the Employer will be issued a 30 days’ notice in advance of termination In the case the term of agreement is for 2 years, the Employee is entitled to 15 days of annual paid leaves in the 2nd year of their contract, given that the Employee has worked more than 80 percent or high attendance rate in the previous year.
Article 12 (Health Insurance, Accidental, National Pension, Taxes)
  1. The Employee will be covered by the Korean National Health Insurance and Pension. According to the government guideline for teachers, the monthly insurance and pension will be shared in half with the Employer. Therefore, Employer will cover 50% of the Employee’s health insurance and pension costs.
  2. Employee may be eligible for tax and/or pension refund; however, it is the Employee’s responsibility to contact the necessary parties to arrange this. Employer will not be responsible for making sure the Employee gets refunded and is not required to assist the Employee.
  3. In the event that the Employee sustains injuries from an accident or mishap outside of the work hours, the Employer will not be responsible or obligated to pay any medical or hospital costs which are in excess of those covered by the medical insurance provided in point 1 of this article.
  4. Taxes and deductions in compliance with Korean Law shall be withheld automatically from the Employee’s monthly salary. The deductions will be income tax, residence tax, medical insurance (50%) and National Pension scheme (50%) and so forth if any, from monthly and severance payment. The total amount of income tax deducted is 3.3% of the Employee’s monthly salary. Income tax includes all incomes paid by the employer.
Article 13 (Severance Pay)
  1. When Employee leaves the institute, Employer shall pay thirty (3) days average salary for each full year of Employee's service (by Korean Law).
  2. When there is ground prescribed by presidential decree, Employer may pay, upon the request of Employee who has been employed for more than one year, Employee an early withdrawal of severance pay. In such cases, the years of employment to calculate severance pay shall newly begin from the date on which early withdrawal is made out.
  3. Severance pay shall be made within 14 days after the date on which Employee left the institute. In the event of early withdrawal, severance pay shall be made out on the first payday after the date on which Employee made such request. In case that the employee is leaving the country, employee shall pay on employee's last working day.
Article 14 (Confidentiality)
  1. Definition of Confidential Information. For the purpose of this Article, "confidential information" means the following:
A. Trademarks developed or registered by Helen Doron, such as Helen Doron Early English, Didi the Dragon, Polly the Collie, Mathjogs, Mathriders, Multimusik, Ready Steady Move and Dada Vinci;
B. Unique and incidental methods distributed through the franchise system of the institute, and other products acquired or developed by the institute, even though they are not yet registered;
C. Entire or any part of information devised by developers or their staff, or any information derived, discovered or developed there from, including but not limited to a discovery, idea, concept, technology, design, customer information, such as customer names, and financial information.
  1. Entire or any part of confidential information shall not be communicated, reported, published, disclosed or passed on to other parties or companies in a direct or indirect manner for the purposes other than those agreed between Employee and developers.
  2. Employer shall pay Employee (all instructors are deemed to be handling confidential information) 50,000 Korean Won per month as a confidentiality allowance, which is included in the salary written in Article 3.1.
  3. At the time of the termination of employment contract, Employee shall immediately return Employer all confidential materials, such as annotations, data, references, maps, models, reports, manuals, documents, reports containing aforementioned contents and other similar items.
  4. Confidentiality obligation prescribed in this Article is in effect for the period of his/her employment and until one year after Employee leaves the institute.
6. In order to enforce this clause, Employee is prohibited to work at other English institute which teaches kindergartners or elementary school students with the same or similar curriculum or text books for the period of his/her employment contract. Employee is also prohibited to work at or open up same kind of institutes in his/her or third party's name for six months after contract termination.
7. Employee is prohibited to work in other English institutes within a 5 km radius of Helen Doron Institutes for 1 year after leaving this workplace.

Article 15 (Regulation)
  1. Employee shall conform to all rules set by Employer, and may not refuse to follow his/her supervisor's instructions without justifiable grounds.
  2. Employee shall not engage in another job or profit-making without attaining prior approval from Employer.
  3. Employee shall not leave work or be absent without Employer's permission. Absence without permission may result in prorated deduction from monthly wage, and two consecutive absences without permission may result in termination of employment.
  4. Employee is prohibited from receiving unreasonable money or entertainment related to his/her job from students and their parents.
  5. Employee shall follow rules and orders in the institute, and shall not drink in a manner which will affect his/her behavior in the institute, gamble, borrow or lend money for profit, sell goods, force donation or engage in any other similar activities that may affect their behavior in the institute.
  6. Employee shall put efforts to keep his/her performance and to develop his/her skills.
  7. Korean Immigration Law requires all foreigner English teachers to receive health checks (HIV, Drug test for heroin, meth, cocaine, and other transmitted diseases) upon their arrival. The health check will be arranged by the Employer; however, the cost of the health check will be borne by the Employee. The cost of the health check will be deducted from the Employee’s first pay in the case Employee is not available to pay for the health check on arrival. If the Teacher receives a positive HIV or drug results, the Employee’s E2 visa will be cancelled by the Korean Immigration Office. In this case, the Employee will be responsible for paying back employer the cost of the air ticket to Korea as well as purchasing their flight ticket to leave Korea.
Article 16 (Hygiene, Presentation, Communication)
  1. Employee shall be presentable at all times and will maintain a high level of hygiene and will be presentable during employment.
  2. Employee shall wear smart casual attire. Clothes with holes or wrinkles should be avoided. Sweatpants, shorts above the knees, mini-skirts, and tank tops are prohibited unless prior approval is given by the Employer. In addition, any kinds of body piercings and visual tattoos must be covered or removed during work hours.
  3. Employee shall communicate positively with co-workers, students and parents.
  4. Employee shall be a non-smoker during working hours and will not smoke on the premises or within 2km radius of the work place at any time during the term of this agreement.
  5. Any violation of the above clauses could result in disciplinary action.
Article 17 (Disciplinary Action and Aggravation)
  1. The Employer has the right to terminate the Employee for the reasons listed below. The Employer and the Employee may terminate the contract with a written notice given 30 days in advance. In addition, Employee shall reimburse Employer for any and all costs incurred due to the Employee’s actions. Any fees borne by the Employer for transportation and visa fees shall be deducted from the Employee’s monthly salary.
  2. The Employer may legally terminate or cancel this contact upon occurrence of any one or more of the following events:
A. The Employee violates Korean laws or has been sentenced to prison;
B. The Employee violates the duties in Article 1 of this contract.
C. The Employee violates the confidentiality agreement outlined in Article 14 of this contract
D. The Employee violates the regulations outlined in Article 15 of this contract
E. The Employee fails to perform or unsatisfactorily performs any of the duties stipulated in this contract. This may include neglecting his/her responsibilities as outlined in this contract; leaving work frequently; giving poor-quality or ineffective lessons, causing frequent complaints on the quality of instruction from students and parents; neglecting his/her duty to keep up with job-related reports without giving notice of justifiable grounds; when behavioaction damages the reputation of the Employer, and other details outlines in this contract. In this event, the Employer shall provide formal written notice of unsatisfactory performance to the Employee. Two or more written notices shall be considered sufficient grounds for termination of this contract.
F. The Employee engages in any other employment (including any part-time, private or self-employment, or online instruction) during the Term of Employment.
G. The Employee fails to perform his/her duties for more than two working days without receiving prior consent from the Employer.
H. Any of the information provided in the Employee’s application is false or inaccurate.
I. The Employee fails the medical health check in Korea in accordance with the requirements of the Korean immigration office.
J. It is determined that the Employee is prevented from or incapable of performing the duties set forth under Article 1 hereof for any medical reason, whether it is physical or psychological in nature, including chronic ailments such as diabetes mellitus, high blood pressure, chronic liver diseases, tuberculosis, neurologic disorder, substance or alcohol addiction, etc. If requested to take a physical and/or psychological examination by the Employer, the Employee must make themselves available. The Employee must agree to take a health at the request of the Employer and submit the results. All related expenses shall be borne by the Employee.
K. The Employee comes to work under the influence of alcohol or illegal drugs; or
L. The Employee has approached a student with sexual intent, or has a sexual relationship with a student;
M. The Employee has committed other misconducts inappropriate as an instructor, damaging the academy's reputation;
N. The Employee has received two warning letters from Employer for dereliction of duties or misconduct. Employer will review and evaluate the situation prior to issuing the warning letter;
O. The Employer has other reasons equivalent to subparagraphs A through N.
  1. If Employee concerned has committed gross negligence or has been subject to disciplinary action before, he/she may be subject to aggravated action, depending on the magnitude and time of disciplinary action taken before.
  2. Employer may take disciplinary actions (Reprimand/Reduction of pay/Temporary suspension/ Demoted/Termination of employment) when Employee:
A. leaves work frequently;
B. violates the duties in Article 1 of this contract
C. violates laws in a blunt manner, while performing his/her job or all other activities;
D. has violated Employer's rules on absence or code of conducts;
E. causes loss to Employer;
F. conducts in any behavior that violates the terms of this contract
G. The Employer has other reasons equivalent to subparagraphs A through F
Article 18 (Compensation for Damage) In the event that Employee has caused loss to Employer as a result of breaching this contract or violating laws due to reasons attributable to Employee (e.g. leaving without enough notice, speaking badly of the institute, hurt other employees(verbally or physically) or any other intentional behavior that causes damage), Employer may put a claim against Employee for compensation.
Article 19 (Commercial Rights)
Employer reserves the right to use any and all materials produced by the teacher for commercial purposes. Materials shall include but not be limited to photos, videos, voice recordings, and teaching materials produced.
Article 20 (Termination of Employment or Leaving Work)
  1. This contract shall be terminated if Employee fails to pass all of Helen Doron's training programs.
Article 21 (Jurisdiction) This contract will be interpreted according to the internal (domestic) laws of the Republic of Korea. A competent court in the Republic of Korea will have jurisdiction in regard to any dispute or claim arising out of, or in connection with, this contract.
Both parties have read, fully understood and agreed on the terms and conditions of the contract written in English and will attempt to resolve any possible dispute in a reasonable manner.
Article 22 (Special Agreement) This agreement shall be the sole and entire agreement between the two parties named above. Both parties acknowledge all the terms set forth in said agreement. Agreement is binding between said parties. This agreement shall be in effect upon execution by both parties.
IN WITNESS WHEREOF, The Employer and the Teacher have each duly executed this Agreement on the dates set forth below their respective signatures.

I take little pleasure in making this post. But I’m sorry to report that despite all its promises, eMusic has failed to deliver, even by its own standards.
As you may recall, back in those halcyon days of yore, when eMusic actually maintained a blog to maintain transparency with its subscribers, many of us were upset with the sudden massive gaps in eMusic’s catalog, especially as they emerged after the debut of the new website. The new site was intended, at least in part, to deal with a problem that had gradually cropped up with the old one, namely that new music wasn’t showing up in a timely manner. We were told that the reason for this is that the distribution systems, from the labels to the site, had gradually gotten corrupted. The site needed more than a mere overhaul; it needed a full-scale replacement. This would make it a million times easier to fix problems as they emerged, since the team responsible for building it in the first place would be the same people in charge of it now.
Well. As we’ve seen, things didn’t work out so well, because content availability is now dramatically worse than it was with the old site. Whereas before, we’d occasionally have a new release delayed months before it finally made it to the site, we now have many dozens of indie labels who no longer have any content available at eMusic whatsoever, whether new releases or back catalogs. So in what follows, I’ve attempted to document everything that has either gone missing or is otherwise unaccounted for. There are some examples that are kind of obvious and wouldn’t be expected to be found here, like the major labels or the Beggar’s Banquet labels (4AD, Matador, etc.). Likewise, given that many indie labels are actually kind of faux-independent, that is, they are affiliates of, or distributed by, major labels, we’d sadly probably not expect to find those here either. What we would expect to find here are genuine, full-throated indie labels. We subscribe to eMusic in large part because most of the music we happen to purchase in any given month happens to be on indie labels. So if those labels aren’t here, if all that’s available at eMusic is “The Best of Hungarian Yak Herding Music, Vol. 4,” then it kind of defeats the whole purpose of subscribing at eMusic. These discounts on music are great, but they ought to be on music we were already inclined to purchase.
Sadly, what we’ve gotten from eMusic of late has mostly just been radio silence. The blog, the Twitter handle and this Reddit board were all supposed to signal a new era of transparency for eMusic subscribers. On July 13th, the blog addressed the missing content directly: “Currently, we’re targeting mid-next month for our next update, but we hope to have more good news for you before then. Please continue submitting issues to [email protected] and sharing thoughts on how to improve our catalog. Our label relations team is listening and are committed to growing the quality and quantity of eMusic catalog.” (https://blog.emusic.com/2017/07/13/label-status-and-feedback/ )
Other than a post reporting the availability of playlists for the eMusic phone app, the blog has essentially gone dark ever since. And of course, mid-August has come and gone. We’re now just a few days from September. Worse still, label content and general availability at eMusic has actually declined since that post. So in what follows, I give you my updated master list of missing and otherwise unaccounted for content. As before, I have to give due credit to all you who have reported all these gaps. I’m personally responsible only for a fraction of what’s in this list; it’s only possible because so many of you have reported what you’ve found (or haven’t found) here. So thanks to all of you.
The only other thing to mention here is that the performance of the eMusic site has grown increasingly erratic. There were two major outages over the last week, coming and going without comment on the blog or Twitter account. Some of us also panicked when even more labels appeared to vanish from the site last weekend. (In this instance, content was on the site, but rendered “unavailable” for 1-2 day period, only to come back just as suddenly.) Again, this came and went without official comment or notification. Some here at Reddit have argued that this may be a good time to consider spending whatever remaining credits you have, on the basis that eMusic is a sinking ship, and may soon evaporate without nary a warning. I hope this isn’t true, and I think we all earnestly hope that eMusic can gets its house in order, and quickly. We’re subscribers to eMusic for a reason: we like this model, and as subscribers, we all have proverbial skin in the game.
So if you’re one of the eMusic staff members tasked with keeping up with this Reddit page, I urge you: please talk to us. Please help this wonderful model for getting great music affordably achieve what was promised, and in so doing, please give us reasons to stay as subscribers. We’d like to, and we’d like to recommend the service to others, but neither will happen if this keeps up much longer.
In what follows, I divide the list between three groups: those labels newly missing as of July or August, the general list of labels missing in their entirety or nearly so, and finally, those which are “patchy,” missing significant portions of their catalog but still retaining some partial availability at eMusic. As before, any corrections, updates, and the like are earnestly requested and highly appreciated, and will be incorporated into this list. The idea is that this list should be organic, and will be continuously edited to reflect any updates the community here submits. (If you’re in the UK, Canada, etc., please say so. I’ll verify whether the label is also missing here in the US.)
